VIII.  New US Gambling Law FAQ
(These are common consensus from experts across the web.  Always consult a lawyer before making your own decision.)

1.  Is it illegal to play online poker in the United States now?
No, except for a few states.  The bill which recently passed addressed deposit methods and financial institutions (banks) that allow gambling transactions, not the players.  A US DOJ official said in a Congressional hearing it was not illegal for US players to play online.  The new law makes it illegal for US banks to allow gambling related transactions so the actual legality of online poker has not changed.  There has been much debate over this issue for years but to this date no one has been arrested for playing poker online.  Although, it is clear that online sports betting is definitely a federal crime nobody has been arrested for playing online poker.  Please see state bans above for more details and possible felonies.

2.  Is it safe to play online poker in the US?
The following question was answered by the authoritative online gambling legal expert, I. Nelson Rose here in September of 2007.  To summarize, he says you are not going to jail for playing poker, it is safe to cash/deposit checks from poker sites as long as you're reporting income and to not keep too much money located at one site because there is the possibility it gets tied up ie: the Neteller & BetonSports incidents.  He also makes a point to be very careful as to what ewallet you use.

3.  Why did Party Poker and other sites close down and yet some sites are still open to the US?
Most of the sites that closed down when the bill was signed were the publicly traded companies.  They closed down to US players to protect themselves from getting sued by their shareholders.  Places like PokerStars.com are privately held and they have addressed the law differently which is why they stayed open.  They believe poker is a skill game.  They also believe their sites aren't classified as "Unlawful" because mainly sports betting was addressed in the 1961 Wire Act defining "Unlawful gambling" and US courts have ruled in the past that not all online gambling is illegal.  Every site has different interpretations of the law.

4.  So what is the deal now?  Is poker banned and what happens next?
People are still playing online poker and we are still in a grace period.  The US government had 270 days from the time the UIGEA bill was signed (Oct 13, 2006) to issue requirements for US banks and payment providers.  The regulations have since been released (view proposed regulations) and were commented on up until Dec. 12, 2007.  After which a "reviewal" period has commenced where the regulations are revamped to incorporate the comments and suggestions.  No deadline was given for the regulations to be amended.  We do know that once regulations are amended banks will likely have 6 more months until they are forced to have the regulations fully running.  It could likely be October 1, 2008 before anything changes.  Read I. Nelson Rose, Gambling Law Professor's view of the proposed regulations.

5.  Am I going to jail if I play online poker?
According to Gambling Law Professor, I. Nelson Rose, you will not go to jail for merely playing poker online.  Again, this bill is attacking the root of the online poker industry, the deposit mechanisms.  No laws have changed for online poker players.  It was always a grey area before this law and remains the same.  Some states have had laws against online gaming for years.

6.  Why are some states not accepted at certain online casinos and poker rooms?
The reason some operators have excluded certain sites and not the whole US population is because they are interpreting the law differently.  The law addresses "Unlawful Internet Gambling."  This means that the casino believes the states that had pre-existing law regarding online gambling are the states affected by this new law.

7.  Why would Neteller, myCitadel, Firepay and other 3rd party transaction sites even think about closing to US gamblers?
The text book answer is that they are a publicly traded company.  But there is much more to it than that.  Let's take Ewallet X (fictitious name) for example.  If the US government felt Ewallet X was used for illegal gambling transactions then the US government could simply stop all banks from making transactions with Ewallet X whether it be for gambling or not.  Some ewallets aren't just in the gambling business and can't afford to lose all their US customers.  Epassporte served US customers for almost a year and a half after the ban before the US DOJ scared them into voluntarily leaving the market as you can see here.  Also, some ewallets went into contracts with certain gambling portals which allow sports bets to be placed among US citizens.  This is against US federal law and is one reason the Neteller co-founders were detained.

July 4

2:57pm - Happy fourth of July everyone.  Here is J. Todd's Friday
Perspectives Weekly video recap.  Everything is slow in the various poker forums so not much bad/good happening this week.  Next week I'll probably do a traffic analysis of the poker sites to see where we stand from a year ago.  The tables have been full the past couple days with traffic peaking pretty high for most US facing cardrooms.

July 2

7:12pm - Some casinos and related poker rooms are fighting back against a recent attempt to stop certain processing methods from going through.  I'm not going to mention names or sites or even the processing methods but a few places out there will have a much better processing conversion rate.....it's mostly for casinos though, atm.  If you're signed up at one of these places you'll get what's called a "player retention" email.

June 28

9:18pm - J. Todd covers the two important topics this week, the HR5767 and the Antigua and US WTO debates.  He says pretty much everything I feel about this whole week  .  Bachus makes me sick...... lies, lies, lies and more lies.  Here's the
Perspectives Weekly  video.

June 27

2:00am - In case you missed the whole HR 5767 stuff that went down this week, Howard Lederrer does a video interview here at cardplayer.  Its a great interview and it saddens me the lies and corruption that goes on in our country.

June 25

5:37pm - The bill HR 5767 which would have stopped the UIGEA regulations from being enforced was defeated today (32-32).  This, at this point in time does not change anything.  The status quo remains the same.  It does not mean everything is fine and dandy though.  Now that this bill was defeated it just adds more fuel to Senator Kyl's saga to get the UIGEA regulations enforced by the Treasury.  But again, we're still left with a complicated garbage law that the banks hate.....so I still believe it will be a long process before anything changes as it stands today.  Keep playing, have fun, screw off Mr. Kyl.

June 24

9:16pm - There's been lots of talk about HR 5767 and most of it is negative.  It seems everyone is hoping for a quick bandaid for the UIGEA but people need to realize this stuff takes a long time, and just because something doesn't pass this year, there are still years to come to take this bull shit (UIGEA) law out.

June 19

12:20pm - Pokerpages wrote an article today saying that the United States had until June 23 to respond to complaints by the European Union over discriminatory gambling acts (the UIGEA).  Also in related news they also had an article that says the US and Antigua have until tomorrow to resolve their WTO dispute.  Here is the article.

Also a PPA member at twoplustwo has posted that HR 5767 (which stops the issuance or the proposed regulations to stop gaming deposits) that this bill has moved to the "mark up" stage and amendments to the legislation has begun.

June 18

12:33pm - This is the response I just got from Eurolinx for any of you in the banned states curious about why some Microgaming sites let you play and some don't.  It'll be interesting to see how long Microgaming allows the sites not enforcing the 11 state ban to continue.

"We are aware of the fact that some Microgaming poker rooms do not have a ban on the 11 US states. However, we have contacted MG regarding this issue and they have stated that a ban on the 11 states still stands."

12:15pm
- I got an email from a Eurolinx rep today saying that the information regarding their site was incorrect.  While they are on the Microgaming network, they are under an 11 state ban + Utah.  It seems as some Microgaming sites are treating banned states differently.  I'll have to contact a few other rooms to see how they decide what side of the fence they're on because nothing seems consistent.

June 15

2:16pm - Wingows poker was purchased by Walker poker this week.  If memory serves me correct Wingows poker was part of that fiasco with Microgaming skins.  Walker poker is under the Merge network (carbonpoker).  There was concerns about Wingows going bankrupt so this acquisition seems like a good thing for anyone who has money in or plays at Wingows.

Also here is the
Perspectives Weekly video by J. Todd.  He goes over the Ultimate bet cheating and other percentages of "illegal gambling" that goes on in other countries.  It was a good show this week especially the video clip at the end.

June 14

1:09am - Here is this weeks brief recap.  On a players note, people in the forums are reporting that Stars and Full Tilt  are finally catching up and sending out withdraw checks in a more timely manner.  (from twoplustwo)

Citadel, an ewallet used for gambling deposits prior to the UIGEA, similar to Neteller, has come to an agreement with the US.  They have agreed to pay $9.1 million in fines.  It's a slap on the wrist considering they processed over $2 billion in transactions during their time before the UIGEA shut them out of the US.  ALL criminal penalties are going to be waved as well as long as they cooperate with the US Department of Justice. (from Cardplayer)

Meanwhile the European Union says they will move forward and continue to probe the United States involving the protectionist "UIGEA" policies by sending EU officials to the United States to interview Senior members of the Bush admin sometime in July. (from online-casinos)

June 7

12:03pm - J. Todd talks about the Partygaming deals, Sportingbet arrests and information about the EU in his
Perspectives Weekly video this week.  He doesnt really get into any news until about half way through.  I will be out for a couple days but I should still have internet access in case something important happens.

June 4

11:18pm - Yet again it's the dog days of summer.  Not a whole lot going on.  After a slow month in May most poker sites seemed to have picked up some traffic over the past week, maybe because it's WSOP advertising time.  Even Ultimatebet is seeing above average traffic peaks despite releasing news about the cheating scandals.

I was browsing the PPA site and came across this picture of an ad they ran in the USA today.  Not bad, not bad.

June 1

3:32am - Partygaming has been rumored to have resolved disputes with the US Department of Justice.  According to the New York Post a 1 billion dollar fine will be imposed on Partygaming.  This resolution will allow Partygaming executives to travel to and from the United States without prosecution.  Party Poker still won't be re-entering the US market of course.  Share price of Partygaming was up 10.9 percent because of early rumors of the news on Friday.  I'm sure there's quite a few stoked Party stockholders who are happy this is overwith.  Partygaming has not commented but I suspect they will on Monday.  Let the mergers and acquisitions begin!

May 28

8:15pm - There are two news stories just coming out.  One involves Betonsports and monies owed to customers, and the other is the US/Antigua WTO agreements.  I'll break down both articles as they are pretty long.

The Antigua Sun reported that the US and Antigua could only be days away from a settlement over the gaming dispute.  In the article Cort, the Minister of Finance for Antigua said he met with lots of high powered officials and was optimistic over these meetings.  He expects an agreement to be made before June 6th.  Here is the full article.

The liquidators of Betonsports gave an update as to customers monies owed and what they expect to happen as things proceed.  Basically the liquidators said Betonsports was insolvent, short for unable to pay their debts because of lack of money.  Their assets were $10 million and liabilities were $27 million.  It goes on to say players are owed an estimated $16 million which was included in the liabilities, good news for those owed money.  The liquidators plan on trying to get back another $8 million from outstanding debt from bettors.  Pretty ironic huh, they owe players $16 million and are after some bettors for bad debt.  Ok, so what you really want to know is....will you get your money back and will it be in full?  The liquidators say they still don't know the date or cents to the dollar that players will get back.  After the liquidators fees and bad debt they'll never recover I can't see how they'll pay every player back ALL the money owed.  They finished the press release with this quote.

"We cannot currently estimate the timing and value of any distribution which may ultimately be returned to the players/creditors."

12:52am - Ok so the funds have completely been depleted from the competition.  Those who emailed in corrections but didn't include their PS account ID please do so for your $20 (3 people).  I appreciate all the help in this.  As I said from the beginning of building this page, I was going to need a lot of help from the people out there to keep up with things.  Over the last year and a half I've gotten so many great emails from the average poker player to some very higher ups in the gaming industry and I appreciate every single email.  Tomorrow it's back to business as usual.  Hopefully someone will turn their $20 into something bigger.

May 27

8:53am - Wow, you guys found some good errors that I never would have noticed, including some sites that went out of business etc.  All good stuff even the spelling errors.  Right now there is $110 left out of the $450 to give away.  Remember to include your pokerstars screen name so I can send the $20 off quickly and so I dont forget.  Everyone did a pretty good comb through so I imagine errors are going to be hard to find now.

May 26

8:16pm - In light of Memorial Day and our 1 billion visitors to this page I'm going to do something a little different today.  I have $450 sitting in my PokerStars account that I want to give away.  Anyone to find a major error on this page will get $20 transferred to them.  It can be as simple as a site listed in the "US accepted spot" that is no longer supposed to be there, or a missing deposit option, to something bigger.....like a mispelling.     I will run this until all $450 has been given out.  All errors must be found above the "archived hourly updates".  Email me at inf o AT compatiblepoker.com with any errors you might have found.  Please use subject line "Roger".

May 24

10:26pm - J. Todd did some interviews in his
Perspectives Weekly video this week.  The one that pertains to poker players is the one with John Pappas of the Poker Players Alliance discussing the new PPA website.  If you're a casino affiliate for gamblingwages there is also a good interview in there with the new manager.  Congratulations J.T. on the 1 million video views.  You still got a long way to match our 1 billion + page views of this page.

Also this week we gained more cosponsors for the bill HR5767 which would put a stop to the creation of the regulations for the UIGEA.  The total is now 18.  It was a slow week so there's really no need for a weekly recap, so I'm off to watch the UFC fight.

May 23

12:01am - An organization called the Public Citizen has filed a lawsuit this week which is pursuing to sue the goverment.  They are doing so over the WTO dispute in which the US government refuses to release details to Americans about the billions in concessions given to the European Union.  This is now the second set of people to demand this information be released in which they consider it illegal, last month it was Barney Frank and Ron Paul.

Also, on a general online poker status quo, some major sites that didn't have Moneygram as a withdraw method now do.  They are just renaming it to something else.  Full Tilt at this time is not one to be doing this but
Pokerstars.com is.  It has become the fastest withdraw method ever since echeck cashouts slowed down dramatically.

May 22

3:38am - This is actually the first I heard of it but Pokerstars is opening up their own brick and mortar poker room in Macau.  It opens up tomorrow.  It looks as if they are building brand awareness in Asia to hopefully capitalize even further in the online market place, although Im still not all that aware of online gaming laws in China.  I always thought they were very strict.  The new site is pokerstarsmacau.com.

May 21

12:03am - The Poker Players Alliance has redesigned their website.  Personally I liked the old one better.  I'm not really sure why they redesigned the site but from a webmaster's perspective they did make it more Search Engine friendly.  Other than that they added advertisements which I have no problem with.  Just more money for the cause.  On a side note I read that the WPT stock has fallen 70% because of the UIGEA according to thestockmasters.com.....ouch.  Oh yeah, I called our friends at the DOJ the other day about the Neteller cofounders.  They're STILL awaiting sentencing.  The press office actually had to call me back about the status because it's been so long since they were arrested.

May 17

9:50pm - J. Todd covers the Washington State court case in this weeks Perspectives Weekly video.

May 16

3:05am -
A third major site has joined the echeck bandwagon.  Absolutepoker.com just released a "soft launch" of a poker echeck option.  It, like Full Tilt is only available for some players.  See review of what other sites accept poker echecks.

2:47am - The Lee Rousso case for Washington State gamblers did not go good this week.  We straight up lost as the judge said it was not unconstitutional.  Here is a short video of the PPA protesting outside, a recap of the hearing, and some interviews.  It remains a felony for any person to gamble online in Washington State.

May 15

8:55am - In the ongoing iMEGA case to put a temporary restraining order on the UIGEA there has been word of a new attorney in the defence of the US DOJ.  His name is Nicholas Bagley.  The next case is to be at the US 3rd Circuit Court of Appeals in Philadelphia.

12:55am - There was an interesting article in the associated press that said Las Vegas is hurting because of the "recession".  In the past gambling has proven to be recession proof.  The article claims that because gambling has become mainstream it is now more vulnerable to economic conditions.  It is true gambling has become somewhat mainstream and I agree with the article to a point.  In the past couple years people got flooded with gambling especially from television and almost everyone had a poker / casino account while the economy was booming.  Now that gambling is just another normal activity to so many more people, bad economic conditions have such an impact.  Of course the article relates to Brick and Mortar casinos.  Online gaming sites will always capitalize because they are global and can move around so easily, which is why we continue to see a rise in gambling online despite what may be happening domestically.

May 14

1:40am -
A few months ago Primapin (a prepaid deposit option) was gaining some traction at casinos and sportsbooks.  Lately it's being removed from a lot of Sportsbooks and even some casinos are now having trouble processing deposits with it.  The only poker site to use it, and still have it is Doylesroom.com

May 12

11:17am - Pokerstars is still having problems with their echeck cashouts.  But there is a plus to this.  It seems Pokerstars is giving players 20% of any amount they tried to cashout as an unrestricted bonus for cashouts delayed from April 14 - May 10.
Pokerstars.com is expecting the problem to be fixed by tomorrow but no promises.  That's pretty good damage control either way.  I'm not sure if there is a limit on echeck cashouts but if you did the max it'll turn out to be a nice little reward for having to wait.

Meanwhile in other countries, the Netherlands will face UIGEA style laws cracking down on internet gambling, announced this weekend.  Dutch banks will be forced to block transactions to at least 45-50 prominent gaming sites.

May 10

10:12pm -
J. Todd released his "edited" version of his Perspectives Weekly video.  Sounds like he got in a bit of trouble with one of the casino operators.  Anyway the one thing he mentioned that kind of stood out was the announcement of The American Gaming Association's decision to stay neutral on the UIGEA.  The CEO believes regulation is 7-8 years away, which I personally agree with even though J. Todd does not.  I just find it disturbing that while they (the AGA) believe regulation will occur, they don't have the balls to stand up for us now to speed things up.

May 9

8:14am - Mastercard is really taking a stand against gambling transactions.  They are literally going through and finding merchants that use their services for gambling deposits and restricting them.  This is hurting the US online casinos more so than poker.  They're definitely becoming active though.  Online gaming companies have already begun to circumvent this which I wasn't given much details on, nor do I want to know how they do it.

May 7

2:26am - Players on various forums are reporting delayed cashouts at both Poker Stars and Full Tilt.  This has happened before so hopefully it gets resolved quickly and isn't a negative sign of things to come.  Sorry for the lack of posting the past few days but I've got some wicked cold.

May 3

2:17pm - This week was really slow which is a good thing.  I'll let J. Todd do the recap this week in his
Perspectives Weekly video.  The main thing regarding the US is Senator Kyl's anxiety over the UIGEA regulations not being published a year after the fact.
